LIMITED LIABILITY COMPANY "BOOKMAKING COMPANY "PARIMATCH", operating in accordance with the License to carry out activities for organizing and conducting casino gambling on the Internet, issued on 04/20/21 based on the decision of the Commission for the Regulation of Gambling and Lotteries No. 137 dated 05.04 .2021, Licenses for organizing and conducting bookmaking activities dated December 28, 2022, issued in accordance with the decision of the Gambling and Lotteries Regulatory Commission to issue license No. 433 dated December 13. 2022 (hereinafter referred to as the “Organizer”), on the one hand, and an individual who, at the time of concluding this Agreement on participation in the gambling game (hereinafter referred to as the “Agreement”), by accepting a public offer (offer), has reached the age of 21 , has full civil capacity, is not on the Register of Persons who have restricted access to gambling establishments and/or participation in gambling, and uses the Organizer's website parimatch at his own request. onl (hereinafter referred to as the “Website”) and/or the Parimatch mobile application (hereinafter referred to as the “Mobile Application”) for participation in gambling (hereinafter referred to as the “Player”), on the other hand (hereinafter collectively referred to as the “Parties”, and each separately - “Party”), have entered into this Agreement as follows:

1. Terms and definitions

Acceptance - the Player’s provision of full and unconditional consent to enter into this Agreement in full, by registering on the Organizer’s Website and creating a player’s client account.

Gambling is any game in which the condition of participation is that the Player makes a bet entitling him to receive a winning (prize), the probability of receipt and the size of which depend entirely or partially on chance, as well as the knowledge and skill of the Player.

Responsible gaming is the basic principle of organizing and conducting gambling, which provides for the implementation by gambling organizers of measures to prevent and minimize the negative consequences of an individual’s participation in gambling, as well as measures aimed at organizing self-restraints and self-control for players.

Organizer's website is a website owned by the Organizer and having the Internet address parimatch.onl, through which the Organizer provides services for organizing and conducting gambling on the Internet. For the purposes of this Agreement, the term Organizer’s Website also means the Parimatch mobile application.

Winning (prize) - funds, property, property rights to be paid (issued) to the player if he wins in a gambling game in accordance with the published rules of such a gambling game.
Player is an individual who, at the time of participation in gambling, has reached the age of 21, is legally capable, is not on the Register of Persons for whom access to gambling establishments and/or participation in gambling is restricted, and who voluntarily participates in gambling.

The player's client account (personal account) is a part of the online system of the gambling organizer, which provides the Player with complete information about his actions, agreements concluded with the gambling organizer, the balance of electronic money substitutes, and also contains the information necessary to identify the Player.

The Parimatch mobile application is a computer program (software) designed to work on mobile devices, with the help of which activities for organizing and conducting gambling are carried out through an online system. For the purposes of this Agreement, the general term “Organizer’s Website” is used.

Organizer of gambling / Organizer - a legal entity, Limited Liability Company "BOOKMAKING COMPANY "PARIMATCH", which, on the basis of received licenses, carries out economic activities in organizing and conducting casino gambling on the Internet, organizing and conducting bookmaking activities in accordance with the Law of Ukraine " On state regulation of activities related to the organization and conduct of gambling.”

Offer - the Organizer’s offer to the Player to enter into this Agreement on participation in a gambling game, on the terms set out in the Agreement, which is posted on the Organizer’s Website.

Rules of the Organizer - Rules of the Organizer of casino gambling on the Internet and bookmaking activities, rules for conducting casino gambling on the Internet, rules for participation in bookmaker bets, rules for sports, posted on the Organizer's Website parimatch.onl.

The register of persons who have restricted access to gambling establishments and/or participation in gambling is a database containing information about individuals who, in accordance with submitted applications or by court decision, are restricted from visiting gambling establishments and participating in gambling.

Bet - cash or a game substitute for the hryvnia, which is transferred by the player to the organizer of the gambling game, is a condition for participation in the gambling game and based on the size of which, in accordance with the rules of such a gambling game, the size of the winnings (prize) is determined.

All other definitions and terms are used in this Agreement in accordance with their definitions and wording in accordance with the Rules of the Organizer and the requirements of the current legislation of Ukraine.

2. Subject and general provisions

2.1 This Public Offer Agreement (Gambling Participation Agreement) is an adhesion agreement within the meaning of Art. 634 of the Civil Code of Ukraine and can only be concluded by joining the other party to it as a whole.

2.2 In accordance with the terms of this Agreement, the Organizer offers services for organizing and conducting casino gambling on the Internet, organizing and conducting bookmaker bets through the Organizer’s Website (hereinafter also referred to as the Services), and the Player, after registering on the Organizer’s Website, has the opportunity place bets and take part in gambling on the Organizer’s Website, in accordance with the Organizer’s Rules.

2.3 By registering on the Organizer’s Website, the Player thereby confirms that he accepts the terms of this Agreement, and is also fully familiar with the Rules, Privacy Policy, Loyalty Program and other documents and policies of the Organizer posted on the Organizer’s Website, and agrees to comply them in full. The agreement on participation in the gambling game is considered concluded from the moment the Organizer accepts the gambling bet from the player.

2.4. To register, the Player must correctly and completely fill out all the required fields of the corresponding application on the Organizer’s Website in the prescribed form. The form contains both the Player’s personal data and additional (non-personalized) data necessary for further identification when restoring access to the personal account. To create a player’s client account in the Organizer’s system and participate in gambling, the Player must undergo an identification procedure (verification, data establishment) in accordance with the requirements of current legislation and the Organizer’s Rules.

2.5. The rules for conducting casino gambling on the Internet, the rules for participating in bookmaker bets, and the rules for sports define special rules and conditions for participation in the relevant game (bet) and are posted on the Organizer’s Website. The fact of placing a bet confirms the Player’s familiarization and agreement with the Organizer’s Rules and the conditions of participation in a specific game (pair).

2.6 The Player guarantees that at the time of concluding this Agreement he has reached the age of 21, has full civil capacity and is not on the Register of Persons for whom access to gambling establishments and/or participation in gambling is restricted, and at his own request enters into this Agreement, and his will is free and corresponds to his inner will. The Player guarantees that he is not under the influence of drugs or alcohol and has no other legal restrictions for concluding this Agreement and participating in gambling.

2.7. If the Player, despite the prohibition established by the current legislation, as well as this Agreement and the Rules of the Organizer, took part in a gambling game, such agreement on participation in the gambling game concluded between the Organizer and such Player is void, and the payment (issue) of winnings (prizes) ) is not carried out under such an agreement.

2.8. If the Player does not agree with the terms of this Agreement and/or the Organizer’s Rules, he is obliged to stop using the Organizer’s Website.

2.9. The organizer confirms that it has the right to carry out activities related to the organization and conduct of gambling on the basis of licenses and in accordance with the requirements of the Law of Ukraine “On state regulation of activities for the organization and conduct of gambling.”

2.10 The Parties agree that this Agreement has legal force, is binding on the Parties and does not require further signing by the Parties in paper or electronic form.

2.11 The Organizer has the right to make changes to this Agreement without prior personal written notice to the Players. Players are notified of changes made by posting relevant information on the Organizer's Website.

2.12 All casino gambling on the Internet is conducted according to established rules. The procedure and timing for placing bets to participate in a gambling game, their size, the procedure for determining the result of a gambling game, payment terms and the procedure for calculating the amount of winnings (prize) for each of the Organizer’s gambling games are determined in the rules of the corresponding gambling game, which are posted on the Organizer’s Website and/or in the menu of the corresponding game.
